  • There is a valid Will and the deceased lived in the UK.
  • If there isn’t a Will you are entitled to be the Administrator of the Estate and you know who the beneficiaries are.
  • There is no foreign property.
  • There is no more than one property.
  • There are no more than 4 bank or building society accounts.
  • There are no more than 4 types of investments directly invested stocks and shares, or share/unit trust portfolios.
  • There are no business assets or agricultural assets.
  • There are no more than 2 Life Policies.
  • There are no pension death benefits.
  • There are no other assets other than listed above.
  • You will deal with the chattels personally.
  • You will deal with the funeral arrangements.
  • There are no unusual debts (apart from those arising as a result of death).
  • There are no more than 5 legatees.
  • There are less than 4 beneficiaries, whose whereabouts are known.
  • There are no disputes between beneficiaries on the division of assets. (If disputes arise this is likely to lead to an increase in costs.)
  • There are no claims made against the estate.
  • There are no ongoing trusts set up by the Will or the Intestacy Rules for minors under 18.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Disbursements which are likely to be incurred on your behalf (in addition to our fee) include:

  • Probate application fee –  This is currently £155.  However, there is a proposal to increase this fee follows:-

  • If any additional copies of the Grant of Representation are required, they will cost £0.50p (1 per asset usually).
  • Bankruptcy-only Land Charges Department searches (£2 per beneficiary)
  • £200 – 300 to advertise  in The London Gazette and Local Newspaper – Protects against unexpected claims from unknown creditors.
  • Optional disbursements include a  Certainty Will Search at £95
  • Land Registry fee(s) to transfer a property/ properties to beneficiaries depending on the value of the property – see Land Registry scale
